Marriage & Protection

(Introduction)

  • Adoption vs. Guardianship:
    • Adoption → पूरा legal parent–child relationship establish करता है.
    • Guardianship → आपके under बच्चा तो रहता है, लेकिन biological parents का legal right बचा रहता है।

(Legal Framework)

  1. Juvenile Justice (Care and Protection of Children) Act, 2015
    • Governs adoption of orphan, abandoned, surrendered बच्चों को through CARA.
  2. CARA (Central Adoption Resource Authority) Guidelines
  3. Guardian and Wards Act, 1890

3. कब Adoption Possible है? (Eligibility Criteria)

  1. Child
  2. Adopter
    • Marital status: Single, married or widow đều

4. Step-by-Step Procedure

  1. CARA Portal पर Registration
    • Accredited Adoption Agency (AAA) से contact करें।
    • Online profile बनाएं और home study report book कराएं।
  2. Home Study & Counseling
    • Financial, social, medical status check
  3. Matching & Referral
    • Agency आपको बच्चे से मिलवायेगी (matching based on preferences).
  4. Legal Adoption Order
    • Adoption consent affidavits file करें।
    • District Court में petition डालें under JJ Act.
  5. Post-Adoption Follow-up

5. Documents Required

  • For Adopter:
    • Birth Certificate, Marriage Certificate (if applicable)
    • Identity proof (Aadhaar, Passport)
    • Residential proof (Electricity bill, Ration card)
    • Income proof (IT returns, salary slips)
    • Medical fitness certificate
    • Police clearance certificate
  • For Child (Relative Adoption):
    • Surrender Certificate signed by biological parents
    • Birth Certificate of child
    • Passport-size photographs

6. Guardian बानने का Optional Route

  1. File Writ Petition under Guardian and Wards Act, 1890 in District Court.
  2. Court की Inquiry:
    • Social Investigation Report (SIR)
  3. Guardianship Order:

(Post-Adoption Takeaways)

8. FAQs

  3. Guardianship vs. Adoption

Quick Takeaway:
