Can Police Freeze My Bank Account Without an FIR in India? This is an increasingly important question for people who suddenly discover that their UPI payments, ATM withdrawals, online transfers or other debit transactions have stopped working.
A bank account can become restricted because it has been connected to a cybercrime complaint, suspicious transaction, disputed payment, money trail or investigation. However, an account freeze does not automatically mean that the account holder has committed an offence.
The important issue is to identify why the account was restricted, who instructed the bank, what amount is affected and what legal process is being followed.
Under the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), Section 106 provides police with powers to seize certain property where it is alleged or suspected to have been stolen or where circumstances create suspicion of an offence. The provision also requires reporting of the seizure to the officer in charge and the jurisdictional Magistrate. (India Code)
The short answer is: the absence of an FIR does not by itself determine whether a restriction on a bank account is legally valid or invalid.
A police investigation can involve financial transactions before the account holder personally sees an FIR or receives a copy of a complaint. In cybercrime cases, for example, investigators may trace money through several bank accounts and ask financial institutions to take action concerning suspected or disputed funds.
The legal basis and procedure matter.
Section 106 BNSS concerns seizure of property in specified circumstances, while Section 107 provides a separate mechanism where a police officer investigating an offence believes property is derived from criminal activity and seeks attachment through the Court or Magistrate, subject to the statutory requirements. (India Code)
Therefore, simply saying “there is no FIR, so the bank cannot freeze my account” can be an oversimplification.
At the same time, a person should not assume that every freeze imposed without an FIR is automatically justified. The specific facts and authority behind the restriction need to be examined.
One of the most common situations involves an online fraud complaint.
Suppose a victim loses ₹50,000 through an online scam. The money may pass through several accounts before reaching the ultimate recipient. If one of those accounts belongs to an innocent person or business, that account may nevertheless become part of the transaction trail.
The Government of India’s National Cyber Crime Reporting Portal specifically provides a facility for financial-fraud reporting, and the official portal directs victims of financial cyber fraud to call 1930 for immediate reporting. (Cyber Crime Portal)

A bank may also restrict transactions because of its own fraud-monitoring, risk-management or compliance processes.
This is different from a restriction specifically communicated by a police or investigating authority. Therefore, the first practical question should be:
Who actually placed the restriction?
Your account may have received money from someone whose transaction was later reported as fraudulent.
This can create a difficult situation where the account holder says:
“I received this payment for a genuine transaction.”
The solution is not simply to argue that the money was legitimate. You should preserve invoices, agreements, order records, payment communications, UTR numbers, screenshots and other documents demonstrating the commercial or personal purpose of the transaction.
A lien and a debit freeze are not necessarily the same thing.
A lien may concern a particular amount, while a debit restriction can affect outgoing transactions from the account. The actual restriction should be confirmed with the bank in writing.
Do not rely only on an SMS saying “debit freeze” or “account blocked.”
Ask the bank for available details concerning:
This information can determine what legal step should come next.
Create a transaction file containing your bank statement, UTR numbers, invoices, payment receipts, agreements, chat records and other evidence showing why money entered or left the account.
For cybercrime complaints, the official NCRP checklist itself identifies transaction information such as the bank/wallet/merchant, 12-digit transaction ID/UTR, transaction date, fraud amount and supporting evidence as relevant information. (Cyber Crime Portal)
If the restriction is connected with a cybercrime investigation, a written representation can be submitted to the concerned investigating authority explaining the transaction and enclosing supporting documents.
The objective should be to establish the legitimate source and purpose of the funds and clarify why the account should not remain unnecessarily restricted.
If the restriction continues despite supporting evidence, or if the disputed transaction does not belong to you, professional legal assistance may become appropriate.
The correct remedy depends on the facts. It may involve communication with the investigating authority, representation to the bank, proceedings before the appropriate court or another legally available remedy.
A person should distinguish between:
No notice from the bank,
no information about the police/cyber complaint, and
no FIR being shown to the account holder.
These are three different situations.
The first step is to obtain whatever information the bank can lawfully disclose about the restriction. If the bank says the restriction originated from a police or cybercrime authority, the next step is to understand the underlying investigation rather than repeatedly requesting the bank to remove the restriction.

Gaming-related payment disputes can create complicated banking issues, particularly when a transaction becomes connected with a larger cybercrime investigation.
If your account has a lien connected with an alleged gaming-app fraud, the focus should be on establishing the exact transaction, the source of funds, the recipient, the payment purpose and the reason the investigating authority has linked your account to the complaint.
This is why the legal question is not simply “How to Remove Bank Account Lien in Gaming App Fraud?”
The more important question is:
Why was the lien imposed, what amount is actually disputed, and what evidence establishes that your transaction was legitimate?
Sometimes the bank can act after receiving appropriate instructions or clearance from the authority that imposed the restriction.
However, where the bank is acting pursuant to an investigative communication, the bank may not have independent authority to simply disregard that direction.
This is why obtaining the source and reference of the restriction is critical.

If the issue concerns a deficiency in banking service rather than the underlying criminal investigation, the RBI’s grievance mechanism may be relevant.
The Reserve Bank – Integrated Ombudsman Scheme, 2026 provides a cost-free alternative grievance mechanism for eligible complaints involving deficiency in service by covered regulated entities. The current scheme came into force on July 1, 2026.

However, an RBI complaint should not be treated as a substitute for responding to an ongoing police or cybercrime investigation. Those are separate issues.

The absence of an FIR shown to the account holder does not, by itself, answer whether a financial restriction is lawful. BNSS provides police and courts with specific powers concerning seizure and attachment of property in defined circumstances. The exact authority and procedure must be examined. (India Code)
No. A bank account appearing in a transaction trail or being subject to a restriction does not by itself establish criminal guilt.
Ask your bank for the type of restriction and available reference details. If the restriction originated from an investigating authority, identify the relevant authority and transaction wherever the bank can lawfully disclose that information.
A cybercrime complaint can trigger investigation and financial measures concerning suspected or disputed transactions. The exact action depends on the facts and applicable legal process.
Keep bank statements, UTR numbers, invoices, contracts, receipts, transaction screenshots, order records and communications demonstrating the legitimate purpose and source of funds.
Where the complaint concerns an eligible deficiency in banking service, the RBI Ombudsman framework may provide an alternative grievance mechanism. The RBI’s current RB-IOS 2026 applies from July 1, 2026.
Can Police Freeze My Bank Account Without an FIR in India? There is no safe one-line answer. A bank account can become involved in an investigation because of a cybercrime complaint, suspicious transaction, disputed funds or a wider money trail, and the absence of an FIR being provided to the account holder does not automatically settle the legality of the restriction.
At the same time, an account freeze does not automatically prove that the account holder committed a crime.
The practical approach is to identify the source of the restriction, determine whether it is a lien, debit freeze or broader restriction, obtain the available reference details, preserve evidence of legitimate transactions and respond through the appropriate legal channel.
If the account has been frozen because your transaction was incorrectly connected with a cybercrime complaint, taking prompt action with proper documentation can be important in seeking appropriate relief.
